Terms of Use

The Site Terms apply exclusively to your access to, and use of, the Site and do not alter in any way the terms or conditions of any other agreement you may have with iScale for products, services, or otherwise.

iScale has adopted a Privacy Statement that you should read to fully understand how iScale uses and collects information. To learn about iScale's privacy practices, please refer to the Privacy Statement section of the Site.

iScale reserves the right to modify these Site Terms in its sole discretion from time to time and only iScale has the right to do so. If the Site Terms are changed, iScale will post the new terms on the Site and note the date they were last updated. Any changes or modifications will be effective upon posting of the Site Terms as revised and your use of the Site following the posting will constitute your acceptance of the new Site Terms.

The Site is operated by a U.S. entity and is governed by the state and federal laws of the United States. The laws of your jurisdiction may be more or less strict than the laws that apply to the Site. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

You may not use the Site or iScale's services if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the government of the country where you are accessing the Site or using iScale's services. You are responsible for compliance with all U.S. or other export and re-export restrictions that may apply to goods, software, technology and services.

iScale grants you a limited license to make personal use only of the Site. Such grant does not include, without limitation: (a) any resale or commercial use of the Site or any Site Materials (defined below); (b) modification, adaptation, translation, reverse engineering, decompilation, disassembly or conversion into human readable form any of the Site materials not intended to be so read; (c) copying, imitating, mirroring, reproducing, distributing, publishing, downloading, displaying, performing, posting or transmitting any Site Materials in any form or by any means; (d) the collection and use of any listings or descriptions; (e) making derivative uses of the Site and/or any Site Materials; or (f) use of any data mining, bots, spiders, automated tools or similar data gathering and extraction methods.

"Site Materials" means all materials on the Site including, without limitation, trademarks, design, product description, HTML text, graphics, other files, photographs, codes, software layout, design forms and the selection and arrangement thereof.

Subject to applicable law, iScale: (a) reserves the right to change the goods and services advertised or offered for sale through the Site at any time without notice; (b) does not warrant that the Site Materials are accurate, complete, reliable, current or error-free; and (c) reserves the right to cancel orders where the price or other material information on the Site is inaccurate.

If you use a password to access the Site or any portion of it, then you are responsible for maintaining the confidentiality of the password and for restricting access to the device you use to access the Site. If the confidentiality of your account or password is compromised in any manner, you must notify iScale immediately, in writing. iScale reserves the right to take any action as it deems necessary to maintain the security of the Site and your account.

All Site Materials are owned by iScale and others and are protected by United States and international copyright, trademark and other laws.

7.2 Trademarks

iScale and its respective designs and/or logos are either trademarks or registered trademarks of iScale and may not be copied, imitated or used, in whole or in part, without the prior written permission of iScale.

7.3 Restrictions on Use

None of the materials and intellectual property described in these Site Terms may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form without the prior written permission of iScale or the respective intellectual property owner.

Any software that may be made available on the Site is licensed to you by iScale on a non-exclusive and limited basis. iScale shall retain full and complete title and all intellectual property rights to Software. You shall not copy, distribute, sell, modify, decompile, reverse engineer, disassemble or create derivative works from any Software.

You are granted a limited, non-exclusive right to create a hypertext link to the home page only of the Site, provided such link does not portray iScale in a false, misleading, derogatory, or otherwise defamatory manner. iScale makes no claim or representation regarding, and accepts no responsibility for, the quality, content, nature or reliability of third-party web sites.

If you register on the Site, you agree that any information you provide to iScale will be current, accurate and complete, and you will promptly update this information if it changes. You agree that any materials submitted to iScale are non-confidential and that you remain solely responsible for your submissions.

iScale has the right, but not the obligation, to monitor any activity and Content associated with forums and interactive areas on the Site. iScale may investigate any reported violation and take any appropriate action, including suspension or termination of your access.

You remain solely liable for the Content or other information you upload or transmit to the Site. You agree to indemnify and hold harmless iScale from any third-party claim arising out of your conduct or violation of these Site Terms.

You must be at least 18 years of age to access or use the Site. This website is designed for and intended for use by adults. If you are under 18, you may use the Site only with involvement of a parent or guardian.

THE SITE AND THE MATERIALS PROVIDED HEREIN ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. iScale DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. iScale DOES NOT REPRESENT OR WARRANT THAT MATERIALS IN THE SITE ARE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL iScale BE LIABLE FOR ANY SPECIAL, PUNITIVE, EXEMPLARY, INDIRECT OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. THE AGGREGATE LIABILITY OF iScale ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED $100.

These Site Terms shall be governed by and construed in accordance with the laws of the State of California. You agree that any action arising out of these Site Terms shall be filed only in the federal or state courts located in San Diego, California.

iScale reserves the right, without notice and in its sole discretion, to terminate your license to use the Site and to block or prevent future access if you violate any of these Site Terms.

When you visit the Site or send email to iScale, you are communicating with iScale electronically. You consent to receive communications from iScale electronically.

This electronic document will be deemed for all purposes to be a "writing" and legally enforceable as a signed writing.

If any provision of the Site Terms is found to be unlawful or unenforceable, that provision shall be severed and shall not affect the validity of any remaining provisions.

No waiver by either party of any breach will constitute a continuing waiver of such breach or be deemed a waiver of any preceding or subsequent breach.
